1. Scope and Purpose
This Acceptable Use Policy ("AUP") defines prohibited activities on Vort Cloud infrastructure and establishes compliance requirements for all customers under Polish and EU law.
2. Prohibited Content and Activities
2.1 Illegal Content
- Content violating Polish criminal law or EU directives
- Copyright or trademark infringement under Polish IP law
- Content promoting terrorism or extremist activities (EU Counter-Terrorism Directive)
- Child sexual abuse material (EU Directive 2011/93/EU)
- Content facilitating human trafficking or exploitation
2.2 Malicious Technical Activities
- Distributing malware, viruses, or malicious software
- Operating command-and-control infrastructure for botnets
- Conducting unauthorized penetration testing or vulnerability scanning
- Launching denial-of-service attacks against any infrastructure
- Attempting to circumvent security measures or access controls
2.3 Spam and Unsolicited Communications
- Sending unsolicited commercial communications violating GDPR Article 21
- Operating open mail relays or SMTP proxies
- Email address harvesting without lawful basis under GDPR
- Violating ePrivacy Directive (2002/58/EC) provisions
2.4 Network Abuse
- Activities degrading network performance for other customers
- Unauthorized network scanning or reconnaissance
- IP address spoofing or falsification
- BGP hijacking or route manipulation attacks
2.5 Financial and Fraud Activities
- Money laundering or terrorist financing
- Credit card fraud or payment processing violations
- Cryptocurrency mining on shared VPS resources (dedicated servers excluded)
- Pyramid schemes or fraudulent investment activities
3. Compliance Obligations
3.1 Legal Compliance
Customers must comply with Polish law, EU regulations, and laws applicable in their jurisdiction of residence or business operation.
3.2 Data Protection Compliance
Customers processing personal data must comply with GDPR, including:
- Implementing appropriate technical and organizational measures
- Conducting Data Protection Impact Assessments when required
- Appointing Data Protection Officers where mandatory
- Reporting data breaches within 72 hours
3.3 Content Liability
Customers are fully responsible for all content uploaded, transmitted, or stored using Vort Cloud services.
4. Reporting and Investigation
4.1 Violation Reporting
Suspected AUP violations should be reported to: abuse@vortcloud.com with detailed information and supporting evidence.
4.2 Investigation Procedures
GeekCloud may investigate suspected violations and suspend services during investigation to prevent harm to infrastructure or other customers, in accordance with Polish procedural law.
4.3 Cooperation with Authorities
We cooperate with Polish law enforcement and EU authorities as required by law, including compliance with European Investigation Orders.
5. Enforcement Actions
5.1 Progressive Enforcement
- First violation: Written warning and corrective action request
- Repeated violations: Temporary service suspension
- Serious violations: Immediate service termination
5.2 Immediate Termination Circumstances
- Illegal content under Polish criminal law
- Activities threatening infrastructure security
- Non-cooperation with abuse investigations
- Repeated violations after warnings
5.3 Appeal Process
Customers may appeal enforcement actions within 14 days by contacting support@vortcloud.com with detailed justification.
